01. Acceptance of Terms & Agreement

By accessing or using Sway, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms in full, you must discontinue using and delete the App. These Terms constitute a binding legal agreement between you and the operator of Sway.

02. The Service & Fair Use

Sway is an AI visual styling companion and digital fitting room. The App provides neural simulation of garment drape, multi-pose perspectives, and fashion video previews. We reserve the right to establish fair-use limits and rate limits on generation requests to ensure server availability and high quality of service for all users.

03. Eligibility & Age Requirements

You must be at least 17 years old (or the minimum legal age required by app store distribution policies in your jurisdiction) to use Sway. By creating an account or submitting photos, you represent and warrant that you meet this age requirement and possess the legal authority to enter into this agreement.

04. User Accounts & Security

To use the App, you may register using supported social authentication providers (such as Apple Sign-In or Google Sign-In). You are responsible for safeguarding your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

05. Your Content & Limited Processing License

You retain all intellectual property and ownership rights in the photos, selfies, screenshots, and clothing images you upload to Sway ("User Content").

• Limited License: You grant Sway a worldwide, royalty-free, non-exclusive license solely to process, render, and store your User Content to fulfill your virtual try-on requests and maintain your private fitting room.
• No Public AI Model Training: We do not use your private selfies or personal photos to train publicly accessible foundation models.
• User Warranty: You represent that you own or have obtained all necessary permissions and rights to upload your User Content without violating any third party's privacy or intellectual property rights.

06. Generated Output

You own the visual try-on previews and video simulations generated for you and may use them for lawful personal or social media sharing purposes. Because outputs are produced via artificial intelligence, you acknowledge that you are responsible for reviewing and verifying generated outputs before relying on them for commercial or high-stakes decisions.

07. AI & Visual Simulation Disclaimers

Sway uses probabilistic generative artificial intelligence and neural physics simulations. All visual try-on results are digital approximations intended strictly for visual inspiration and outfit exploration.

• Not a Tailoring Guarantee: Renderings do not guarantee exact physical garment fit, precise fabric elasticity, real-world texture feel, or retail sizing chart accuracy.
• Visual Variance: AI generations may produce visual artifacts or minor variations depending on input lighting, image quality, background contrast, and device camera resolution.
• Adaptive Generation Speed: Generation speed varies dynamically based on resolution choices, video animation length, and cloud compute capacity.

08. Third-Party Trademarks & Retailers

All third-party brand names, boutique logos, e-commerce garment screenshots, and trademarked designs uploaded by users remain the exclusive property of their respective owners. Sway is an independent visual simulation tool and is not affiliated with, authorized by, endorsed by, or sponsored by any third-party clothing brand, designer, or fashion retailer.

09. In-App Purchases, Subscriptions & Billing

Sway offers credit packs and recurring subscriptions (such as Starter, Pro, and Max tiers) for generating high-definition renders and motion video clips.

• Platform Billing: All purchases and subscriptions are processed directly through Apple App Store Billing (for iOS) or Google Play Store Billing (for Android).
• Auto-Renewal & Cancellation: Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours prior to renewal in your Apple ID or Google Play account settings.
• Refunds: Refund requests are subject to the policies of Apple or Google, as we cannot issue direct refunds for app store transactions.

10. Acceptable Use & Prohibited Conduct

You agree not to upload or generate: (a) sexually explicit, pornographic, or non-consensual imagery; (b) content depicting or exploiting minors in any manner; (c) defamatory, harassing, or violent material; or (d) content that infringes any third party's copyright, trademark, or likeness rights. You further agree not to reverse engineer, scrape, automate, or disrupt Sway's infrastructure or neural models.

11. Data Retention & 1-Tap Photo Purge

You have full control over your stored visual data. The App provides a 1-tap "Delete All My Photos" setting that permanently deletes your uploaded selfie photos, clothing pictures, and generated try-on renders from our active databases. You may also delete your entire account at any time.

12. Intellectual Property

All software, algorithms, neural workflows, UI designs, graphics, branding, and trademarks associated with Sway are the intellectual property of Sway and its licensors. You are granted a limited, non-transferable, revocable license to use the App for personal styling purposes.

13. Termination

We reserve the right to suspend or terminate your access to the App immediately without prior notice if you violate these Terms or engage in fraudulent or abusive conduct. Provisions that by their nature should survive termination shall remain in effect.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SWAY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Sway, its founders, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or retail purchase disputes arising from your use of the App or reliance on AI visual simulations. Some jurisdictions do not allow the exclusion or limitation of certain liabilities; in such jurisdictions, our liability is limited to the fullest extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless Sway, its officers, and employees from and against any claims, damages, liabilities, and legal expenses arising out of your User Content, your violation of these Terms, or your infringement of any third-party rights.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any legal disputes arising out of these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts located in France.

18. Changes to Terms

We may update these Terms periodically. When changes are made, we will update the "Last updated" date at the top of this page. Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes.
